Public Offer

This Public Offer (hereinafter referred to as the "Offer") sets out the terms and conditions of use of the website platform (hereinafter referred to as the "Platform") provided by EATAGRAM GROUP LIMITED (Company Number: HE 453678, Company Address: Flat 15, Pot. Germasogeias, 14 Georgiou A, 4047 Germasogeia) (hereinafter referred to as the "Platform Operator" or "We"). The Platform is an online service that connects users with catering establishments (restaurants, bars, cafes, etc.), allowing them to search, make reservations, leave reviews, and interact in other ways.
Use of the Platform implies full and unconditional acceptance of the terms of this Offer. Acceptance occurs by registering an account, using the Platform's functionality, or by any other means confirming agreement with the Offer. If you do not agree with the terms of the Offer, please refrain from using the Platform.
The Offer is made in accordance with European Union law, including the E-Commerce Directive (2000/31/EC), the Digital Services Act (DSA, Regulation (EU) 2022/2065), the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679), as well as other applicable EU regulations on consumer protection, digital services, and intermediary liability.
We reserve the right to make changes to the Offer at any time. Changes take effect from the moment they are published on the Platform. Continued use of the Platform after the changes have been made constitutes acceptance of the updated Offer.
1. Terms and definitions
- Platform: An online service accessible via the website https://www.plattr.me/ and mobile applications, providing functionality for interaction between users and establishments.
- Regular users (hereinafter referred to as "Users"): Individuals who have registered an account on the Platform for personal use.
- Establishments: Restaurants, bars, cafes, and other catering establishments whose profiles have been added to the Platform on behalf of their owners or authorized representatives.
- Establishment owners (hereinafter referred to as "Owners"): Individuals or legal entities that own establishments, or their authorized representatives (directors, managers, SMM specialists, etc.) who use the Platform's functionality on behalf of the establishment.
- Establishment employees: Individuals registered on the Platform independently or added by the Owner to perform tasks related to the establishment.
- Account: A user or establishment profile on the Platform created after registration.
- Content: Any information posted on the Platform, including reviews, publications, photos, videos, comments, etc.
- Reservation: A request to reserve a table at an establishment through the Platform.
- Events: Events created and published on the Platform by users or Owners.
- Personal data: Information provided during registration (e-mail, first name, last name, year of birth, telephone number) and other information in accordance with the GDPR.
2. Registration and accounts
2.1. To use the full functionality of the Platform, you must register an account. Registration and searching for establishments is available to persons aged 16 and over, but services such as booking and purchasing alcohol are only available to persons aged 18 and over who have full legal capacity in accordance with EU law.
2.2. When registering, the User provides: e-mail, first name, last name, year of birth, telephone number. This information must be accurate, complete, and up to date. The User is responsible for updating their information in case of changes.
2.3. When registering an account for an establishment, owners agree to:
- Provide only accurate, complete, and truthful information;
- Not impersonate another person, including by using someone else's name or forging documents;
- Update information in case of changes (e.g., change of owner, address);
- Register an account only after receiving the appropriate permission from the establishment owner (if an authorized person is acting on their behalf);
- Be fully responsible for all actions in the account and/or using its login and password;
- Be solely responsible for registering/adding employee profiles and obtaining their consent to the processing of personal data;
- Ensure that all licenses and permits required by law for activities in the field of public catering are available.
2.4. The Platform is not responsible for the provision of inaccurate, incomplete data or data of third parties without their permission by the Owners.
2.5. The Platform reserves the right to refuse registration, restrict access, block, or delete an account if:
- The data provided is insufficient;
- There are reasonable doubts about the veracity/accuracy/completeness of the data or the person's connection to the establishment;
- A statement has been received from a third party regarding the rights to the establishment with confirmation.
2.6. Automated registration (by bots) is prohibited. The user is obliged to keep their login and password confidential and to notify the Platform of any unauthorized access.
3. Platform Services
The Platform provides the following services in accordance with the role of the subject:
3.1. For Users:
- Search for establishments by selected parameters;
- Add an establishment profile (if authorized);
- Rate establishments and write reviews;
- Reserve tables;
- Create and search for events;
- Add publications, comment on them, and "like" them;
- Subscribing to other users and establishments.
3.2. For Establishment Owners:
- Adding an establishment profile and filling it with information (description, photos/videos);
- Adding employees to the profile;
- Responding to user reviews;
- Confirming table reservations;
- Creating events;
- Adding posts, commenting on them, and liking them;
- In the future: accepting food delivery orders.
3.3. The platform acts as an intermediary service provider within the meaning of the DSA and Directive 2000/31/EC.
3.4. Services are provided "as is," without any guarantees of continuity or absence of errors. The Platform may modify the services to comply with the law, for improvement, or for technical reasons.
4. Rights and obligations of Users
4.1. Users have the right to use the Platform's functionality in accordance with the Offer.
4.2. Obligations:
- Provide accurate data;
- Do not post illegal, offensive, false, or misleading Content;
- Notify of cancellation of a reservation (may result in account restrictions);
- Comply with Content moderation rules;
- Do not violate the intellectual property rights of third parties;
- Do not use the Platform for spamming, hacking, or other illegal activities.
4.3. In the event of 4 or more cancellations within 12 months, the account may be suspended.
5. Rights and obligations of Establishment Owners
5.1. Owners have the right to use advanced features to manage their establishment's profile.
5.2. Obligations when using the functionality (reservations, reviews, employees, photos/texts, chats, events):
- Ensure the quality of services, food safety, and compliance with EU standards (e.g., food hygiene);
- Confirm/cancel reservations;
- Respond to reviews constructively;
- Obtain consent from employees for the processing of their data;
- Do not post illegal information;
- Bear full responsibility for disputes with Users (e.g., poor service);
- Update availability and prices.
5.3. Owners guarantee that authorized persons have the authority to act on behalf of the establishment and bind it to obligations.
5.4. The Platform is not responsible for the actions of Owners or the quality of the services provided by Establishments.
6. Processing of personal data
6.1. The Platform processes Personal Data in accordance with the GDPR. The Platform Operator is the data controller.
6.2. Purposes of processing: provision of services, moderation, analytics, marketing (with consent), compliance with the law.
6.3. Rights of data subjects: access, rectification, erasure, restriction, portability, objection, withdrawal of consent. Requests should be sent to vlad@plattr.me.
6.4. Data is stored for as long as necessary for the purposes or as required by law. Transfer to third parties (e.g., Establishments as joint controllers for reservations) with safeguards.

6.6. Users consent to the processing of data upon registration. For children under 16, parental consent is required.
7. Intellectual Property and Content
7.1. The Platform and its elements (design, code) belong to the Operator. Users grant a non-exclusive license to use the posted Content.
7.2. The Platform moderates Content in accordance with the DSA: removal of illegal content (e.g., offensive messages, fake content, etc.) upon notification. Users can report violations via the form. For details, see our Moderation Policy.
7.3. Owners are responsible for the Content of the establishment. The Platform does not monitor Content, but responds to complaints.
8. Liability of the parties
8.1. The Platform is not responsible for:
- Inaccurate data or actions of Users/Owners;
- The quality of the Establishment's services;
- Losses due to customer no-shows, cancellations, or disputes;
- Third parties (payments, integrations).
8.2. Limitation of liability:
- For regular Users (consumers within the meaning of Directive 93/13/EEC): We are not liable for indirect, incidental, special, or consequential damages, except in cases of intentional misconduct or gross negligence. Services are provided "as is," without any guarantees of continuity, availability, or absence of errors, to the extent permitted by EU law.
- For Business Owners (business users): In addition to the above, our total liability is limited to EUR 100 or the amount paid for services over the last 6 months, whichever is greater, to the extent permitted by EU law. Liability for indirect damages is excluded, except in cases of intentional misconduct or gross negligence.
8.3. Users/Owners undertake to indemnify the Platform against any third-party claims arising from their actions.
9. Termination
9.1. The User may delete their account at any time.
9.2. The Platform may suspend/delete an account for violations of the Offer, suspected fraud, or DSA requirements.
9.3. After termination, data is deleted in accordance with the GDPR.
10. Applicable law and dispute resolution
10.1. The Offer is governed by the law of the Republic of Cyprus, without conflict of law rules.
10.2. Disputes shall be settled in the courts of Limassol, Republic of Cyprus.

11. Final provisions
11.1. The Offer constitutes the entire agreement. The invalidity of one provision shall not affect the others.
